1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Burna AI, Inc. ("Burna AI," "we," "us," or "our") governing your access to and use of our healthcare AI platform, services, software, mobile applications, and related documentation (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our Services.
2. Description of Services
Burna AI provides AI-powered clinical intelligence tools designed to support healthcare professionals in clinical documentation and workflow optimization.
Current Services
- CTCAE grading (v5.0 and v6.0)
- Multi-drug attribution algorithms
- Clinical guidelines integration
- Patient self-reporting module
Service Limitations
- Clinical decision support tools only
- Do NOT replace clinical judgment
- AI suggests, clinicians decide
3. Eligibility and Account Registration
3.1 Eligibility: Licensed healthcare providers, research professionals, and authorized entities. Must be 18+.
3.2 Registration: Provide accurate info, maintain confidentiality, update promptly.
3.3 Responsibility: You are responsible for all activity under your account and notifying us of breaches.
4. Acceptable Use Policy
You may use Services solely for legitimate healthcare/research purposes. Prohibited uses include violating laws, reverse engineering, disrupting service, and unauthorized access.
Healthcare-Specific Requirements
- All AI content must be reviewed by qualified professionals
- Patient safety protocols followed at all times
- Adverse events reported to authorities
- Appropriate patient consent obtained
5. Data and Privacy
Ownership: You retain ownership of all data. We claim no ownership of clinical content.
Protection: Compliance with HIPAA/privacy laws. Encryption in transit/rest. See Privacy Policy.
Usage: Aggregated/de-identified data used for improvement/research. Never sell personal info.
6. Intellectual Property Rights
We own our platform, algorithms, and AI models. You own your data. Feedback you provide may be used without restriction.
7. Service Availability
We strive for high availability but do not guarantee uptime. Support provided via contact@burna.ai (2 business days response).
8. Payment Terms
Fees per subscription agreement. Billed in advance. Non-refundable generally. Free tier may be limited.
9. Mobile Application Terms
App Store/Google Play terms apply. License is limited/non-exclusive. You must keep app updated.
10-18. Compliance & Legal
HIPAA
BAA required. PHI handled per HIPAA. Security safeguards maintained.
Disclaimers
"AS IS" service. No medical advice. Clinicians responsible for decisions.
Liability
Capped at 12 months fees or $100. No indirect damages.
Termination
Convenience (30 days notice). Cause (immediate for breach).
Account Deletion: Settings > Account > Delete. Permanent deletion in 30 days.
Governing Law: Delaware. Arbitration for disputes. Class action waiver.
